These terms govern purchasing of digital products from lepunktnoir.gumroad.com in a legally binding way so please read this document carefully.

There is nothing in these terms that creates an employment relationship or a partnership between the parties.

Digital Products

Digital products listed in my shop are hosted on Gumroad, Inc. a product marketplace that allows me to host and collect payments for my digital products.

When purchasing my products from Gumroad, these Terms apply in conjunction with the Terms and Conditions and Privacy Policy set by Gumroad:

Categories of digital products:

There are two categories of products listed in my shop:

  • Paid Products
  • Free Products/Freebies

Product Descriptions

When purchasing or downloading products, please read the product descriptions carefully. Some listed products have certain software/hardware limitations and in order to make sure you are able to use the product after download, make sure you confirm you have all the necessary requirements to use the product.

Every listing also contains details about what is included in the product in written form as well as through showcase images, but if you have any questions before purchase feel free to reach out via contact details listed above.

Purchasing Process and Download of Free Products

For Paid Products:

  • you will see a button on the right side of the listing with the text “I want this!” and the price will be shown on the left side in a yellow flag.
  • When you click on the button, a form will open where you will be directed to fill it out.
  • The total charged will be listed below along with added VAT in the amount that depends on the country you are in. Gumroad collects and redistributes VAT to appropriate authorities for all paid products. https://help.gumroad.com/article/10-dealing-with-vat
  • When you are ready to pay click on the button “Pay”
  • You can cancel the order anytime before clicking the “Pay” button by simply clicking on the “X” in the left corner.

For Free Products:

  • you will see a button on the right side of the listing with the text “I want this!” and a filed with a greyed out price “0+” above that.
  • Write “0” in the price field and then click “I want this!”
  • When you click on the button, a form will open where you will be asked to leave your email address, and once you do, click the button “Get”

Order Submission and Delivery of Digital Content

Once you placed your order, whether it’s a paid or free product you will receive an email to address you provided, with instructions and a link for download. Make sure to keep that email if you wish to download the files again in the future.

If you have an account on Gumroad, you will also be able to see the product in your “Library”.

In some cases one hour after purchase you will receive a thank you email with more instructions and a discount code for future purchases.

Prices and Discount Codes

You will be informed about any additional charges that may apply to your purchase before you click the “Pay” button, like the VAT charge. Since these are digital products, no shipping fees are applied.

If you have a discount code, you will have an opportunity to apply it in the order form, before you make a purchase. This does not apply to free products.

Payment Methods

Payment method available is Credit Card and some Debit Cards. PayPal is currently not supported for my products. You can see a full list of cards supported by Gumroad here

Usage Rights and Ownership

By purchasing any of the products from my shop you are NOT granted with the Ownership of the products or any of it’s parts but you are given Usage Rights as follows:

  • Procreate Brushes (Free or Paid) – personal and commercial use in unlimited amount of projects
  • Fonts (Paid) – personal and commercial use in unlimited amount of projects
  • Worksheets and PDF’s (Free) – personal use only
  • Paper Backgrounds (Paid) – personal and commercial use in unlimited amount of projects, under condition they are a part of a larger design

You are NOT allowed to share the files, even the free files, with anyone else but you are welcome to share links to the products so other people can purchase or download the products themselves.

Email collection after purchase

When you make a purchase or download a free product, you agree that your email automatically gets added to my Customers list and used to send you an email with a link for downloading the product you purchased or downloaded for free, and you also agree to be contacted in the future in case there is an update to the product your purchased or downloaded for free. All updates to the products are free of charge.

In some cases you will also receive a “thank you email” with common questions answered and a discount code for future purchases.

If you decide to follow my shop to receive updates about future products or discounts, you agree that your email is added to the Followers list and to be contacted when new products are added to my shop or when there is a special discount.

You can always unsubscribe from any of these lists by clicking on “Unsubscribe” at the bottom of the email or letting me know directly, and I will manually delete your email from the lists.

Your email will never be transferred to a different email service and you will be contacted by me, only through Gumroad Emails.

If you do not wish to leave your email on Gumroad but still want to purchase or get a free product, reach out to me directly via email listed above and I will send you the product directly.

User Rights and Refunds

Right of withdrawal

EU costumers have a right to withdrawal in the period of 14 days after purchase, without any reason. In cases of digital products that are not delivered in any physical form, according to the BGB Section 312f (3) the right of withdrawal/refund expires as soon as:

  • your order is being fulfilled or
  • you consent and acknowledge you forfeit the right to withdrawal during the order process

However, if you have any issues with your product, please let me know via email listed above, and I will work with you to resolve the issue in any way I can. Even though all of my products are digital products, if the issue can’t be resolved I will issue you a full or partial refund through Gumroad depending on the specific case.

Digitale Produkte

Die in meinem Shop aufgeführten digitalen Produkte werden auf Gumroad, Inc. gehostet, einem Produktmarktplatz, der es mir ermöglicht, Zahlungen für meine digitalen Produkte zu hosten und zu erfassen.

Beim Kauf meiner Produkte von Gumroad, gelten diese Bedingungen in Verbindung mit den Allgemeinen Geschäftsbedingungen und Datenschutzbestimmungen von Gumroad:

In meinem Shop gibt es zwei Kategorien von Produkten:

  • Kostenpflichtige Produkte
  • Kostenlose Produkte/Freebies

Produktbeschreibungen

Wenn Sie Produkte kaufen oder herunterladen, lesen Sie bitte die Produktbeschreibungen sorgfältig durch. Einige der aufgeführten Produkte haben bestimmte Software-/Hardware-Beschränkungen. Um sicherzustellen, dass Sie das Produkt nach dem Herunterladen verwenden können, vergewissern Sie sich, dass Sie alle notwendigen Voraussetzungen für die Verwendung des Produkts haben.

Jede Auflistung enthält auch Details darüber, was in dem Produkt in schriftlicher Form als auch durch Showcase-Bilder enthalten ist, aber wenn Sie irgendwelche Fragen vor dem Kauf haben, fühlen Sie sich frei, über die oben aufgeführten Kontaktinformationen mir zu kontaktieren.

Kaufprozess und Download von kostenlosen Produkten

Für kostenpflichtige Produkte:

  • sehen Sie auf der rechten Seite des Angebots eine Schaltfläche mit dem Text “I want this!” und der Preis wird auf der linken Seite in einer gelben Flagge angezeigt.
  • Wenn Sie auf die Schaltfläche klicken, wird ein Formular geöffnet, das Sie ausfüllen müssen.
  • Der Gesamtbetrag wird unten aufgeführt, zusammen mit der zusätzlichen VAT, die von Ihrem Land abhängt. Gumroad sammelt die VAT für alle bezahlten Produkte ein und führt sie an die zuständigen Behörden ab. https://help.gumroad.com/article/10-dealing-with-vat
  • Wenn Sie bereit sind zu bezahlen, klicken Sie auf die Schaltfläche “Pay”.
  • Sie können die Bestellung jederzeit abbrechen, bevor Sie auf die Schaltfläche “Pay” klicken, indem Sie einfach auf das “X” in der linken Ecke klicken.

Für kostenlose Produkte:

  • sehen Sie auf der rechten Seite des Angebots eine Schaltfläche mit dem Text “I want this!” und darüber ein Feld mit einem ausgegrauten Preis “0+”.
  • Schreiben Sie “0” in das Preisfeld und klicken Sie dann auf “I want this!”
  • Wenn Sie auf die Schaltfläche klicken, öffnet sich ein Formular, in dem Sie aufgefordert werden, Ihre E-Mail-Adresse anzugeben. Klicken Sie dann auf die Schaltfläche “Get”.

Übermittlung von Aufträgen und Lieferung digitaler Inhalte

Sobald Sie Ihre Bestellung aufgegeben haben, egal ob es sich um ein kostenpflichtiges oder kostenloses Produkt handelt, erhalten Sie eine E-Mail an die von Ihnen angegebene Adresse mit Anweisungen und einem Link zum Herunterladen. Achten Sie darauf, dass Sie diese E-Mail aufbewahren, wenn Sie die Dateien in Zukunft erneut herunterladen möchten.

Wenn Sie ein Konto bei Gumroad haben, können Sie das Produkt auch in Ihrer “Bibliothek” sehen.

In einigen Fällen erhalten Sie eine Stunde nach dem Kauf eine Dankes-E-Mail mit weiteren Anweisungen und einem Rabattcode für zukünftige Käufe.

Preise und Rabatt-Codes

Bevor Sie auf die Schaltfläche “Bezahlen” klicken, werden Sie über etwaige zusätzliche Gebühren informiert, die für Ihren Kauf anfallen können, z. B. die VAT. Da es sich um digitale Produkte handelt, fallen keine Versandgebühren an.

Wenn Sie einen Rabattcode haben, haben Sie die Möglichkeit, diesen im Bestellformular anzuwenden, bevor Sie einen Kauf tätigen. Dies gilt nicht für kostenlose Produkte.

Zahlungsmöglichkeiten

Als Zahlungsmittel sind Kreditkarte und einige Debitkarten verfügbar. PayPal ist derzeit nicht für meine Produkte unterstützt. Sie können eine vollständige Liste der Karten von Gumroad unterstützt sehen here

Nutzungsrechte und Eigentumsrechte

Mit dem Kauf eines der Produkte aus meinem Shop erhalten Sie NICHT das Eigentum an den Produkten oder Teilen davon, sondern Sie erhalten Nutzungsrechte wie folgt:

  • Procreate Brushes (Kostenlos oder kostenpflichtig) – persönliche und kommerzielle Nutzung in einer unbegrenzten Anzahl von Projekten
  • Fonts (Kostenpflichtig) – persönliche und kommerzielle Nutzung in einer unbegrenzten Anzahl von Projekten

Es ist Ihnen NICHT gestattet, die Dateien, auch nicht die kostenlosen, an andere weiterzugeben. Sie können jedoch gerne Links zu den Produkten weitergeben, damit andere Personen die Produkte selbst kaufen oder herunterladen können.

E-Mail-Sammlung nach dem Kauf

Wenn Sie einen Kauf tätigen oder ein kostenloses Produkt herunterladen, erklären Sie sich damit einverstanden, dass Ihre E-Mail automatisch zu meiner Kundenliste hinzugefügt wird und dazu verwendet wird, Ihnen eine E-Mail mit einem Link zum Herunterladen des gekauften oder kostenlos heruntergeladenen Produkts zu senden, und Sie erklären sich auch damit einverstanden, in Zukunft kontaktiert zu werden, falls es ein Update für das gekaufte oder kostenlos heruntergeladene Produkt gibt. Alle Aktualisierungen für die Produkte sind kostenlos.

In einigen Fällen erhalten Sie auch eine “Dankes-E-Mail” mit Antworten auf allgemeine Fragen und einem Rabattcode für zukünftige Einkäufe.

Wenn Sie sich entscheiden, meinem Shop zu folgen, um Updates über zukünftige Produkte oder Rabatte zu erhalten, erklären Sie sich damit einverstanden, dass Ihre E-Mail zur Follower-Liste hinzugefügt wird und dass Sie kontaktiert werden, wenn neue Produkte zu meinem Shop hinzugefügt werden oder wenn es einen speziellen Rabatt gibt.

Sie können sich jederzeit von diesen Listen abmelden, indem Sie unten in der E-Mail auf “Unsubscribe” klicken oder mich direkt benachrichtigen, und ich werde Ihre E-Mail manuell aus den Listen löschen.

Wenn Sie nicht möchten, dass Ihre E-Mail auf Gumroad zu hinterlegen, aber immer noch wollen, zu kaufen oder ein kostenloses Produkt zu erhalten, erreichen Sie mich direkt per E-Mail oben aufgeführt und ich werde Ihnen das Produkt direkt schicken.

Nutzerrechte und Rückerstattung

Widerrufsrecht

EU-Kunden haben ein Widerrufsrecht innerhalb von 14 Tagen nach dem Kauf, ohne Angabe von Gründen. Bei digitalen Produkten, die nicht in körperlicher Form geliefert werden, erlischt das Widerrufsrecht nach § 312f Abs. 3 BGB, sobald:

Auch wenn alle meine Produkte sind digitale Produkte, wenn das Problem nicht gelöst werden kann, werde ich Ihnen gerne eine vollständige oder teilweise Rückerstattung durch Gumroad, je nach dem spezifischen Fall, ausgeben.
